Ray Throckmorton

 

Mr. Throckmorton has consulted on a broad range of projects with attorneys, corporate management, licensing professionals and corporate boards of directors.  He has provided expert testimony in commercial contract disputes on accounting, marketing, and financial issues, appeared before the U.S. Tax Review Board, served as expert for an arbitration panel and as judge in an arbitration dispute. He has been involved in over 350 cases and testified in approximately 27 matters including intellectual property (patent, copyright, trademark and trade secret), accounting for business combinations, APB 20, FAS 157, FAS 141 and FAS 142, breach of contract, accountant and attorney malpractice, securities, business interruption, lender liability, and fraud.  

 

Industries have included healthcare (cardiovascular, plaster casts, pharmaceutical), construction (bridges, urinals, polystyrene plants, nuclear power plants and waste water treatment plants), technical (software, hardware, networking, telecommunications electronic trading, satellites, garage door openers, GPS Systems), financial institutions, securities, diapers, insurance, publishing, chemical, athletic, automobile, and jet engines, among others. 

 

He has also performed a number of royalty audits involving medical products and devices, several national sporting goods companies, the Player’s Association of a Professional Athletic league, GPS Systems and Nitrogen Welding systems. He has advised on issues such as development of IP strategies, financing through securitization, disposal of intangible assets, monetization, and cost and pricing analyses. 

 

Ray lectures regularly on breach of contract, intellectual property, royalty auditing and expert witness testimony.  He spoke with Judge Farnan on the Effective Selection, Preparation and Use of Expert Witnesses.  He also speaks on diverse topics such as Royalty Audits in China and Labor Saving Approaches and Tools for Patent Portfolio Valuation Extraction-A Financial Model and had a roundtable discussion on Asian License Compliance. 

 

Ray is a CPA and holds an MBA from Illinois State University. He is a member of the Licensing Executive Society, past chair of the Financial Markets Committee, member of the Intellectual Assets Reporting Standards Committee, past Associate Member of the American Bar Association and a member of both the Illinois CPA Society and the American Institute of Certified Public Accountants. He has given over 40 speeches to the Licensing Executive Society, LESI in Scotland and England, World Research Group, Insight Conference on Technology Licensing, American Bar Association, ABA Section of Litigation, and the DuPage County Bar Association. He has taught at the Center for Intellectual Property Studies in Gothenburg, Sweden, John Marshall Law School and the Chicago Bar Association Intellectual Property Committee. He has published in IAM-Intellectual Assert Management, Thompson Financial, and had a chapter in Russell L. Parr’s book on Intellectual Property Infringement Damages.
